A New Radio Performance Royalty 'Tax' Battle Looming?

no-performance-tax

Is there a new attempt to impose performance royalties for airing recorded music on broadcast radio? A North Carolina Democrat Congressman says he thinks there should be. Rep. Mel Watt says he will introduce legislation that would establish -- as it has in the past -- what the NAB calls a "performance tax" that "would negatively impact local radio stations across America." Although the legislation has yet to be introduced, or gain any major support, NAB EVP of Communications Dennis Wharton has quickly issued a statement on behalf of the broadcasters association. "NAB strongly opposes a new performance tax that would kill jobs at America's hometown radio stations while diverting millions of dollars to offshore record labels. We continue to support private, company-by-company negotiations that are driven by the free market, as is reflected by recent deals between broadcast radio stations and independent music labels. We appreciate the support of 154 members of Congress who know that local radio remains the premiere platform for exposing new music and generating sales for record labels." So far at least, there seems to be more congressional support for the non-binding resolution known as the "Local Radio Freedom Act" which opposes any performance royalties for over-the-air radio stations. Reps. Michael Conaway (R-TX) and Gene Green (D-TX) introduced the LRFA in the House of Representatives on February 15, along with 71 additional co-sponsors. An identical resolution was introduced in the Senate on March 6 by Sens. John Barrasso (R-WY) and Heidi Heitkamp (D-ND). The Local Radio Freedom Act says, "Congress should not impose any new performance fee, tax, royalty, or other charge relating to the public performance of sound recordings on a local radio station for broadcasting sound recordings over-the-air, or on any business for such public performance of sound recordings."

SiriusXM Reports Record Q2 Revenue of $940M, Up 12% from 2012

SiriusXM

SiriusXM reports record second quarter 2013 revenue of $940 million, up 12% from Q2 2012 revenue of $838 million. Net income for the second quarter 2013 and 2012 was $126 million and $3.1 billion, respectively. Net income in the second quarter of 2012 benefitted from a $3 billion reversal of deferred income tax valuation allowances. Income before income taxes rose 47% to $202 million in the second quarter compared to $138 million in the second quarter of 2012. Adjusted EBITDA for the second quarter of 2013 reached a record $283 million, up 19% from $237 million in the year ago period. "SiriusXM's second quarter results reflect record performance on almost every vital metric: the 25 million subscriber milestone, record revenue, adjusted EBITDA and adjusted EBITDA margin. We grew our revenue at double digit rates for the sixth consecutive quarter while being very mindful of our costs as we invest in advanced IP and telematics platforms designed to provide more services to our subscribers and automakers," says SiriusXM CEO Jim Meyer. "Our increase in adjusted EBITDA guidance speaks to our excellent first half performance as well as our outlook for further growth later this year. SiriusXM has now purchased 391 million shares of its common stock so far this year for nearly $1.3 billion, and we plan to continue using our growing free cash flow and strong balance sheet in a very disciplined way to reward our investors," adds Meyer. Adjusted EBITDA climbed 19% from last year's second quarter to a record quarterly figure of $283 million, and a record adjusted EBITDA margin of 30%. Net subscriber additions in the quarter were 715,762, up from 622,042 in Q2 2012, "marking the largest quarterly gain since the fourth quarter of 2007." The satcaster tells us, "Our total paid subscriber base reached a record 25.1 million, up 9% from the prior year period. Self-pay net subscriber additions were 423,076, while the self-pay subscriber base reached a record high of 20.3 million, up 9% from the prior year period. Total paid and unpaid trials grew by 528,000 from the first quarter 2013 to 6.7 million." Says SiriusXM EVP and Chief Financial Officer David Frear, "During the second quarter, we repurchased 195 million shares of our common stock for $650 million. We also repurchased approximately $130 million in principal amount of our outstanding debt during the second quarter. Following our $1 billion debt issuance in May, the company's outstanding debt was approximately 3.2x our trailing adjusted EBITDA, below our target leverage of 3.5x. Combined with our strong cash position of $652 million and undrawn revolving credit facility of $1.25 billion, we have tremendous flexibility to continue pursuing capital returns, debt repurchases, and acquisitions." "After increasing its total net additions guidance on July 9, 2013, the company today increased its 2013 guidance for adjusted EBITDA and reiterated guidance for subscriber growth, revenue, and free cash flow: self-pay net subscriber additions of approximately 1.6 million, total net subscriber additions of approximately 1.5 million, revenue of over $3.7 billion, adjusted EBITDA of approximately $1.14 billion, and free cash flow of approximately $915 million," according to a news release.

Radio One: Katz Terminating Their National Sales Deal

Radio One

Radio One says Katz is terminating its representation of them for national advertising sales. In a form 8-K filed with the SEC, Radio One says, "On July 22, 2013, Radio One, Inc., together with certain of its operating subsidiaries received notice from Katz Communications and various of its divisions and affiliates that Katz was terminating its national sales representation of the Company effective 14 months from the date of the notice, as provided under the terms of various representation agreements and a master representation agreement." The filing adds, "While the termination notice would provide for a termination of the relationship between Radio One and Katz effective September 23, 2014, the parties are in continued negotiation with respect to a new sales representation agreement. While the Company cannot guarantee that an agreement will be reached with respect to continued sales representation by Katz, Radio One anticipates completing a new sales representation agreement with Katz or another sales representative prior to the Effective Termination Date and does not anticipate any interruption with respect to national sales representation."

FCC Commissioner Ajit Pai Continues Support of Radio

Ajit Pai

FCC Commissioner Ajit Pai continues to demonstrate that he's a friend of radio. And that he remains concerned about the future of the AM band. Wednesday, Pai visited historic KDKA-AM, Pittsburgh, using the occasion to address his interest and concerns. Pai spoke of the historical importance of KDKA-AM, which dates back to 1920, as well as the history of Pittsburgh's radio stations. "The AM band is facing significant challenges. Every day it gets harder to pick up a clear AM signal. The percentage of listening done on the AM dial has sharply declined, especially among the young. That's why I have called for the FCC to launch an AM Radio Revitalization Initiative," said Pai. "We need to comprehensively review our AM radio rules and explore proposals for improving the band. Over the course of the last ten months, I've heard great ideas from broadcasters across the country, and now is the time to take action. In recent weeks, I have had very productive discussions with FCC Chairwoman Mignon Clyburn about AM radio. She is a friend to broadcasters, and I am hopeful that we will see progress in the coming months." Pai noted, "In every field, it's important for the FCC to make sure that our regulations keep up with the times. But especially when it comes to radio, we're overdue for an overhaul." He gave an example of the FCC's "Contest Rule," which requires broadcasters to "give notice of all the nuts and bolts of any contest they run in periodic over-the-air-announcements. These announcements, needless to say, aren't the most compelling content in the world, and they can lead listeners to turn the dial. Maybe this once made sense. But not in today's point-and-click world, where listeners would rather go to a webpage to read the contest rules if they want to read them at all. That's exactly what broadcasters proposed as a replacement last year, and no one opposed this common-sense proposal. It's time for the FCC to take action on this issue and others like it." On another topic, Pai says the ongoing delays in the quadrennial media ownership rules review are "unacceptable." In Pittsburgh he said, "Congress mandates that the FCC review our media ownership rules every 4 years. We launched our last review in 2010, but we are now in the second half of 2013 and it still isn't done. This is unacceptable. It is time to bring our so-called Quadrennial Review to a close and to modernize our regulations to reflect the current media marketplace. One rule, in particular, that I want to eliminate is the newspaper-radio cross-ownership rule. In today's day and age, if you think that the combination of a newspaper and a radio station poses a real threat to competition and diversity, then I have one of Pittsburgh's 446 bridges that I'd like to sell you."

Univision (Finally) Officially Announces Exit of Eddie 'Piolin' Sotelo

Eddie Piolin Sotelo

After several days of silence, Univision Radio today officially announced that Eddie "Piolin" Sotelo -- the longtime host of Univision's morning show "Piolin por la Manana" -- has exited the company. "After a ten-year run, Sotelo and Univision have agreed to part company," says Univision Radio in a news release. As previously reported, Sotelo broadcast his final show on Monday. Sotelo's program had grown to over 50 affiliates. "It's been a great run with Univision," said Sotelo, who was recently elected to the National Radio Hall of Fame. "We thank Eddie for the contributions that he has made while at Univision Radio," says Univision Radio President Jose Valle. There's still no explanation of the abrupt exit of "Piolin" which came so quickly and suddenly that Univision Radio had no replacement to offer and has been filling the morning show time slot with unhosted music. Rumors, though, are rampant that Sotelo will soon announce plans to offer a self-syndicated show, and is currently having studios prepared. Some reports say Univision found out about that planned move and decided to abruptly pull the show Monday afternoon. At least two credible sources are suggesting Sotelo could be ready to start broadcasting on his own network of stations within two weeks. Meanwhile, Univision still is silent on its plans to replace "Piolin por la Manana," although the company has told its own stations that aired the show they can't reclaim the time slot for local programming. Affiliates not owned by Univision may bail according to some reports out of Los Angeles.

Microsoft Discuss New Xbox As Cable Box Replacement

Posted: 21 May 2013 12:34 PM PDT

While the most important date in the history of the ‘new Xbox’ concept is today with the official console announcement, creators Microsoft are not letting the impending reveal detract them from other matters that could normally be cast off to the side for a while, such as the possibility of the console being used as a ‘home entertainment system’ as well its first and foremost priority as a games console.

xbox_revealFor this purpose, Microsoft are believed to be in talks with a number of cable TV operators, in order to replace their respective ‘set-top boxes’ with the new Xbox.

The way in which this would work would be online delivery of content (fitting if the rumours surrounding the new Xbox’s operational methods are to be believed), as opposed to the cables from which pay-tv gets its name, meaning  operators such as Time Warner about the possibility of delivering content through the web instead of traditional cable pipes, and would lead to a corporate ‘cord-cutting’ should any company take up Microsoft’s offer.

One currently being rumoured for such treatment is Time Warner, with the new Xbox’s ‘multimedia capabilities’ planned as a draw for executives to see the potential of using Xbox as the source of any new set-top box.

While it remains unlikely that any major provider would veer away from the status quo for such a huge risk, Microsoft are strong in their belief that their new product is more than just a ‘games console’, and have even avoided referring to it as such, as the Envisioneering Group’s Richard Doherty reported to Bloomberg, noting: “They might not even use the phrase game console this time around because they’re trying to pitch it as this incredible entertainment hub in the home.”

NPD analyst Liam Callahan, meanwhile, offered an opposing view, claiming that nothing will surpass what the Xbox is best known for amongst consumers, stating: “Those entertainment options are important – in a sense they are almost a given, but gamers won’t buy a next-generation console from Sony or Microsoft for that.”

Inside the company, meanwhile, the impending reveal has triggered a period of reflection on what the previous ‘generation’ of consoles delivered to the industry, with Microsoft’s former chief executive Peter Molyneux unsurprisingly claiming that the Xbox 360 was the most memorable ’7th-gen’ product compared to the Sony PS3 and Nintendo Wii. He summarised: “2013 is proving to be the year of the console hardware refresh. Although it’s exciting, it’s not nearly as exciting as when the Xbox 360 exploded onto the gaming scene just over seven years ago. Back then, the 360 represented a huge leap forward in gaming, with a tangible increase in performance and fantastic multiplayer support. Gamers and game-makers were justifiably super-excited. Now it is that time again, but the world has changed. Tablet, mobile PC and smartphone makers are refreshing their hardware on what feels like almost a weekly basis. And on the horizon looms Valve with its PC-based Steam Box. Thereby hangs the problem for Microsoft: how to justify its new console, how to get us all excited.”

They will attempt to begin that process in two parts, with today’s event primarily focused on the product’s hardware, with the E3 gameshow next month providing details on some of the launch games that could be seen whenever the console arrives. With this seeming to represent a focus on gaming for the time being, how much of a difference will the new Xbox truly be from its predecessor, and will those larger differences be likeable ones? ABC Ask Celebrities To Sing Their Face Off

Posted: 21 May 2013 09:14 AM PDT

While the title might imply a very Hollywood new-age botox removal process, American network ABC are instead looking at an unusual new addition to their summer programming line-up.

sing_your_face_off_logoThe format, which will see actor John Barrowman (Doctor Who) present, will take five celebrities each week undergoing a complete transformation into the same musical icon, replicating their mannerisms and voice and competing to find the best ‘replica’.

Based on an existing format in Spain from Endemol called Your Face Sounds Familiar (Tu cara me suena) that has been exported to over 20 countries, Sing Your Face Off will take on a six-episode run by the network, with current confirmed celebrity contestants (who will then have to impersonate another famous person) including actresses Lisa Rinna and China Anne McClain, comedian Jon Lovitz, and musician Sebastian Bach, amongst others.

The judging panel will so far consist of Debbie Gibson and Darrell Hammond, while it is also believed that the ’idol’ of the week being impersonated will have a key role to play, with challenge-setting, coaching, judging, and guest performing likely to be amongst the possible uses for such a singer.

The Hollywood Reporter noted of the planned show: “Each episode will feature the complete physical transformation — including the icon’s walk, talk, mannerisms and more — as the celebrities compete in front of judges and a studio audience. In addition to being tasked with a physical transformation, participating talent  also will have to actually perform music from their assigned icon each week. Participating celebs will transform to play — and sing — multiple musical performers during the series. Details on prizes still are being worked out.”

The official premiere date is currently unconfirmed, but in what will most likely be a barrage of celebrity suck-up speeches and tributes, will its target audiences find a better use for their summer than ‘another singing contest’, or could the mimic format become a breakout success for the network? If any lesson could be given to producers ahead of attempting this, it should be that it only gets really entertaining when you see the multiples on-stage at the same time:

HTC One Scales New Heights With Everest Video Call

Posted: 21 May 2013 02:48 AM PDT

Since ‘the tallest mountain’ and ‘the deepest sea’ are naturally referred to as some of the most isolated places on the planet, it can be near enough guaranteed that they are the locations with some of the worst mobile signal coverage, although the exemption to that rule is the literal former example (Mount Everest) and its status as a popular enough ‘destination’ to be able to support even the most data-heavy calls.

everest_million_htc_challengeThe concept was this week officially proven by Taiwanese company HTC, whose HTC One phone was used in the world’s first-ever ‘video call from the summit of Mount Everest’. At 8,848m above sea level, the call between charity climber Daniel Hughes and the BBC News team will not be surpassed as the highest (on solid ground at least), while temperatures of -35°C also ensured it would be one of the coldest locations for a web-chat.

Hughes, participating in a project for the UK’s Comic Relief fundraising drive, aimed to raise £1m through his ascent, and has been recording key moments of his journey through the HTC One and its ’Immarsa mobile satellite technology’ (where signal interference would naturally not be a problem for any satellite receivers to handle).

Much like astronauts in the 1970′s who had endless ideas to be able to accomplish ’first x on the moon’, Hughes also marked a number of ‘achievements’ that were unlikely to have been done before hand, performing ‘the world’s highest Harlem Shake’, and being the first to place a red nose (the symbol of Comic Relief) at the summit, which serves as a border between Nepal and Tibet (China).

Hughes explained his pride at his accomplishments, stating in the satellite interview: “This project has been two and a half years in the making and it’s hard to put into words how amazing and surreal it is to be speaking to London from the highest point in the world. The support for the expedition has been phenomenal and thanks to the interactive nature of the climb, I really felt like I had everyone behind me.”

A HTC spokesperson added from a safer location: “We pride ourselves on being at the forefront of design and innovation and the HTC One was put to the ultimate test in extreme conditions, where it was able to help Daniel connect to everyone back home – even from the top of the world. We’re truly proud to have been part of Daniel’s amazing journey.”

The ‘landmark phone call’ can be seen below, while supporters of his effort are encouraged to donate via the ‘Everest Millions‘ website. With the highest possible video chat (without being in a plane or in orbit) now complete, it is up to rivals such as Samsung, Apple, or Google to see HTC’s boast and raise it (or lower it, since ‘deepest call’ would have to be the most attainable record now)…

Ofcom Plan Live TV Subtitle Delay

Posted: 20 May 2013 01:57 PM PDT

UK media regulatory body Ofcom have recently proposed a shake-up to the way that live TV displays subtitles, claiming that a mandatory delay period could be a method implemented in order to lessen the possibility of error.

ofcom_bad_subtitlingThe system would be one only made to ‘improve the quality’ of the broadcasting service, with a several-second gap believed by the organisation to be enough time to make any necessary amendments such as the one pictured.

That example occurred in an episode of ITV chatshow Loose Women, which along with a caption from BBC Weather provided visible instances of errors made in this department.

The plans come after Ofcom reviewed the current system and asked for feedback from TV viewers, with the primary recommendations to emerge being that the ‘timing and accuracy’ of live show subtitles was questionable and needed to be fixed, including ‘words lagging behind voice’, ‘freezing’, and typos.

A summary statement from the regulator read: “Viewers have made clear that there are continuing problems with the speed, synchronisation, accuracy and presentation of live TV subtitling.”

Ofcom representative Claudio Pollack added: “Ofcom wants to see an improvement in the quality of subtitling on live programmes for people who are deaf and hard-of-hearing. Our proposals will help identify the areas where broadcasters can make progress, leading to a better viewing experience over time.”

Although the implementation of subtitles by broadcasters is only formally required in the case of an ‘average viewing share’ of over 0.05% for its network, the demand is believed to be quite high, with 7.6m adults said to ‘actively use’ subtitles, though just 1.4m of them were classed as having a hearing impairment, so with its popularity extending far beyond necessity, is subtitling an issue that demands more respect than it currently receives for current live broadcasts?
